Membership in Exclusive Exchanges luxury home exchange will continue for a period of one year from the date of acceptance, and be renewable per annum upon acceptance of the membership fee.
Exclusive Exchanges luxury home exchange offers one additional year of membership at no additional charge at the request of any member who has made a good faith effort to arrange an exchange, but has been unable to secure a home exchange arrangement.
Acceptance of membership to Exclusive Exchanges luxury home exchange will be taken an express agreement of the following: Members agree to use the Exclusive Exchanges website and their privileges of membership for lawful purposes only, and agree to not engage in any behavior which infringes on the rights of others, including but not limited to the privacy of members of Exclusive Exchanges. In an effort to maintain a geographic balance of home exchange destinations, Exclusive Exchanges reserves the right to cancel any memberships at any time, with a full annual refund given to said member
Members agree to contact other members of Exclusive Exchanges only for the express purpose of arranging an exchange or rental of a member property, and that any advertising or solicitation of products or services wholly unrelated to the purposes of an exchange or rental between two Exclusive Exchanges member properties is prohibited, and will result in fine of not less than $500 per each member solicited. Any attempt to solicit email addresses from members for the purpose of sending them commercial solicitations is prohibited, and will result in a fine of not less than $500 per each member solicited.
In the event of a non-simultaneous home exchange arrangement, both members agree to honor the particulars of the home exchange agreement. Should circumstances arise which are beyond the control of a member, said member agrees to act in good faith to re-schedule the date of the home exchange or otherwise reasonably compensate the home exchange partner.
Exclusive Exchanges luxury home exchange shall not be held liable for any consequential or incidental costs which a member may have incurred in the process of arranging a home exchange or rental. By becoming a member of Exclusive Exchanges, you agree that any home exchange or swap, hospitality exchange or rental transaction is between you and the other party. You agree that neither Exclusive Exchanges nor its' affiliates bear any responsibility of liability for any aspect or outcome of the arrangement. Exclusive Exchanges is a luxury home exchange website which is a portal or an online 'meeting place' through which members can view other member's listings, and contact other members for an exchange or rental. As such, Exclusive Exchanges is not involved in any way in the actual transaction, and has no control over the truth or accuracy of the listings, nor do we make any representation as to the ability of members to meet their obligations. By becoming a member of Exclusive Exchanges luxury home exchange, you agree that you bear all responsibility for making and effectuating the arrangements, and for any outcome thereof.
Exclusive Exchange members are wholly responsible for ensuring the accuracy of a potential exchange or rental by corresponding with members, asking for photos, and asking for references.
Members are expected to leave the exchange property in the condition in which they found it, or better. Members are responsible for any damage that any member of their party may cause to another member's property.
Acceptance of these Terms and Conditions as herein set forth, is considered to be an acceptance of and consent to: (i) pay all legal fees and court costs incurred by Exclusive Exchanges, a division of Sojourning Concepts, LLC in the event that an action of law or in equity is initiated by Exclusive Exchanges against said member and Exclusive Exchanges and Sojourning Concepts, LLC should prevail;and, (ii) That the member agrees to pay all legal fees and court costs incurred by Exclusive Exchanges, a division of Sojourning Concepts, LLC, in the event that an action of law or equity is initiated by the member against Exclusive Exchanges, a division of Sojourning Concepts, LLC, should Exclusive Exchanges prevail in said action.
Acceptance of these Terms and conditions as herein set forth, is considered to be an acceptance of and consent to submit any and all disputes to the jurisdiction of the courts of Fairfax County, Virginia, United States of America, and that said agreement shall be governed exclusively by the laws of the Commonwealth of Virginia, United States of America.
Privacy
Exclusive Exchanges luxury home exchange is committed to the maintenance of your privacy, and will not disclose or rent any information collected at this site. Exclusive Exchanges may use member images for purposes of publicity related solely to luxury home exchange. Exclusive Exchanges luxury home exchange will not reveal your name, street address, phone number or email address or make them available over the World Wide Web. It is left to the sole discretion of the individual members as to when and to whom they will disclose this information.
